Booking terms and conditions

1. Definitions

In these terms and conditions, the following words shall have the meanings set out below:

“Booking Form” the series of pages for the booking of the places on the Conference or Workshop

“Delegate(s)” attendee(s) or potential attendee(s) of a Conference and/or Workshop.

“Materials” any materials provided to Delegates when they attend a Conference and/or Workshop.

“Venue” the location of the Conference and/or Workshop as stipulated on the Website and/or Booking Form.

“Website” the website located at the URL http://virtualworldsforum.com/http://www.virtualeconomicforum.com and any other VEF websites.

2. Contract With You

2.1 Your contract with Virtual Economic Forum Limited (“VEF”)  will be concluded as follows:

2.1.1 Completion of the Booking Form (which includes the provision of your credit and debit card details) shall constitute an offer by you to purchase a place or places on a VEF conference and/or workshop (“Conference”, “Workshop”) as stated on the Booking Form and as described on the Website subject to these terms and conditions of booking;

2.1.2 On electronic receipt of the Booking Form, VEF will check that all parts of the Booking Form have been completed correctly and will confirm that you have sufficient funds to cover the total cost of the booking.

2.1.3 On confirmation of the details in clause 2.1.2, VEF will charge your credit or debit card the full fee (“Fee”) for all places booked for the Conference or Workshop accordingly and send you a Confirmation by e-mail which will set out: (i) your booking reference; (ii) details of the number of places reserved on the Conference and/or Workshop together with details of the venue, date, and the Contract price

2.2 You are entirely responsible for entering your details (and the details of other delegates for whom you are responsible) correctly on the Booking Form. You warrant that all details supplied by you are true and accurate.  If there are any changes to your details once your booking is concluded then it is your responsibility to inform VEF.

2.3 Where a person makes a booking on behalf of any one or more other delegates, that person accepts these terms and conditions on behalf of all delegates and is responsible for all payments due from the other delegate(s).

2.4 If you have claimed any discount on the Fee you must provide proof of your entitlement to the same in default of which VEF may require that you pay the amount of any discount that you have received

2.5 All bookings are subject to availability and VEF is not obliged to conclude any Contract on these Terms.

3. Alterations, Cancellations and Refunds

3.1 This agreement shall commence on the date upon which the formalities set out at 2.1 are concluded (“Effective Date”) and shall continue until the earlier of:

3.1.1 the completion of the Conference and/or Workshop;

3.1.2 cancellation of the Conference or Workshop.

3.2 If you are making a booking for a Conference and/or Workshop acting as a consumer, you shall be entitled to cancel this contract in accordance with the rights granted to you by The Consumer Protection (Distance Selling) Regulations 2000.  Consumers in the European Union are entitled to cancel a booking within a period of 7 working days, beginning with the day after the day on which the booking has been madeAs soon as VEF receives a written notice of cancellation by of a booking a refund will be made.

3.3 Notwithstanding clause 5.2, any consumer or business may cancel a registration and request a full refund at any time no less than 90 days before the date of the relevant Conference or Workshop whereupon payment will be refunded less an administration charge of £100; no refund will be given where cancellations are made after a date 90 days prior to the date of the Conference or Workshop. Delegate substitutions are welcome at any time.

3.4 Notices of cancellations should be sent to:

3.5 If you are registering for a Conference and/or a Workshop on behalf of a Company, you warrant that you are authorised to enter into a legally binding contract on behalf of that company.

3.6 Should you be unable to attend a Conference and/or Workshop then in the event that you are unable to attend a Conference and/or Workshop you may nominate a substitute Delegate to attend in your place, provided that VEF is informed of the change at any time prior to the relevant date of the Conference or Workshop, in which case, no extra fee shall be payable.

3.7 VEF shall be entitled to cancel any Conference or workshop and terminate this agreement by notice to you in which case a place will be offered to you for another Conference or Workshop during the period of 15 months following the date of that for which the booking was originally made.

3.8 VEF reserves the right to make any alterations in the arrangements (including but not limited to the date, time, itinerary, or speaker(s)) relating to any Conference and/or Workshops for any cause.

4. Limitation of Liability

4.1 VEF will only be responsible for any losses you suffer as a result of it breaching these Terms if the losses were reasonable foreseeable to VEF and you on the Effective Date.

4.2 VEF shall not be liable in any way if a Conference and/or Workshop is abandoned after more than half of it has taken place due to factors which are beyond VEF’s  control.

4.3 Without prejudice to clause 4.2, the there shall be regarded as factors beyond VEF’s control any act of God, fire, earthquake, strike, civil commotion, act of government, act of terrorism or any other event of  force majeure and any delay or failure to provide a Conference and/or Workshop due to the acts of third parties including, but is not limited to, internet service providers, data centres, server hosting companies and telecommunications companies.

4.4 VEF will not be responsible for any business loss, loss of profits, revenue, contracts, anticipated savings, data, goodwill, business or business benefit or wasted expenditure or any indirect or consequential loss.

4.5 VEF’s total liability for claims arising out of the breach of this contract or arising from the subject matter of this contract shall be limited to the total value of the Fee.

4.6 Nothing in these Terms shall be interpreted as excluding or restricting any legal liability of VEF for death or personal injury resulting from the negligence of VEF.

5. During the Conference and/or Workshop

5.1 VEF reserves the right to refuse admission and may request a Delegate to leave before or during a Conference or Workshop.  VEF shall take such action as is necessary to enforce this right.  VEF may conduct security searches to ensure the safety of those attending the Conference or Workshop.

5.2 VEF cannot guarantee and does not promise any specific results from attendance at any Conference and/or Workshop. Conferences and workshops are provided to you strictly on an "as is" basis. All conditions, representations and warranties, whether express, implied, statutory or otherwise, including, without limitation, any implied warranty of non-infringement of third party rights, are hereby

6. Proprietary Rights

6.1 VEF has sole and exclusive ownership of all copyright and all other intellectual property rights, in and to the Conference and Workshop(s) and Materials, including all copyright, trade marks and any other intellectual property rights therein. This contract conveys a limited right and license to use the Materials but shall not be construed to convey title to or ownership of the Material or grant any right to copy the Materials, which is strictly prohibited.  All rights in and to the Materials not expressly granted to you are reserved by VEF. 

6.2 VEF shall have sole and exclusive ownership of all copyright and any other intellectual property rights in and to any photographs or audio-visual footage taken or feedback collected at or in relation to a Conference or Workshop and you hereby consent to being included in and to the exploitation of the photographs and audio-visual footage for marketing purposes by VEF or comments that you make on any feedback forms regarding the Conference or Workshops without payment.

6.3 VEF’as rights under this clause shall survive termination of the agreement as provide at 3.1.

7. General

These Terms shall be governed by and construed in accordance with English law and the parties hereby submit to the exclusive jurisdiction of the English courts and shall constitute the entire agreement and understanding between the parties with respect to the subject matter hereof and cannot be altered except by agreement in writing executed by an authorised representative of each party.

Twinity gets government funding for Singapore replica

Twinity has announced that it has been awarded funding by the government of Singapore for its development of a virtual equivalent of the city. Twinity is a virtual world which aims to create virtual replicas of the leading cities of the world. They have already built Berlin, with Singapore and London next in the pipeline. For more background, check out my interview with Twinity's Chief Marketing Officer from our Unplugged gathering earlier this month. As part of the deal, Twinity will also be launching geo-tagging capabilities in the virtual world. Presumably this will involve media assets, such as pictures or videos, of real world places being connected to the virtual equivalent in Twinity.

The aspect of the announcement which most interests me is the fact that that they have attracted government funding for this. Metaversum are quite open about the fact that developing mirror worlds is an expensive operation – a potential disadvantage against competitors such as Second Life which can mostly rely upon users for content generation. If Metaversum could attract local government funding for development of more cities, that could go a long way to alleviate the problem. Whilst I'm sure many governments would not be easily persuaded to put money into a virtual world, some could embrace it, perhaps as a tourism marketing exercise or to help in a real world regeneration effort by improving the virtual environment first to create a buzz around an area.
